
Applicability
The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 is a legislative act in India that seeks to protect women from sexual harassment at their place of work. The act applies to companies that have 10 or more employees (full time, part- time, off rolls, interns or consultants included) & also to form an Internal Complaint Committee (IC) for the safety of their employees at all the administrative units. The committee should comprise of a minimum of 4 members, and half of them should be females. The Law is applicable to all kinds of Organisations – Private and Public Sector companies, Government Bodies, Ministries, NGOs, Schools & Colleges etc.

Non- Compliance
Non-compliance to POSH act will result in a substantial monetary penalty of up to INR 50,000. In case of repeated defaults, the amount can exceed to double the amount and can even lead to cancellation of license or non-renewal of registration. However, employers should look at complying with this Law, not because of these penalties but because sexual harassment free work environment would lead to better growth of the business.
